The Obama campaign and the DNC have filed a joint motion to dismiss a lawsuit filed by Pennsylvania Democrat, Phil Berg claiming that Obama is not a US citizen. According to World Net Daily Berg has stated that if Obama produces a valid birth certificate he will gladly drop the suit.
The web site Obama Crimes has up to the minute information on the status of the lawsuit. In this press release Berg states that Obama and the Democrats are purposely slowing the legal process so this will remain unresolved until after the election, which according to Berg, would result in a Constitutional crisis.
In July Pamela Geller at Atlas Shrugs reported on the findings of a technical forensic expert’s examination of the photo of the birth certificate published by the Daily Kos which they allegedly obtained from the Hawaii Department of Health in 2007. The expert concluded that the Obama certificate is a “horrible forgery”. The detailed report contains many images and outlines the specific techniques he used to reach his conclusions. Also notable, but not surprising, is that he was threatened by left-wing psychopaths.
The big question is why Barack Obama won’t simply produce a certified copy of his birth certificate? Wouldn’t that be much simpler than fighting a lawsuit?

Update 10/9/08: Earlier I went to check on the status of the Phil Berg lawsuit and when I clicked on the Obama Crimes website there was a message that the site crashed.
Update 10/15/08: Obama Crimes is back up, new format.
Update 10/25/08: Phil Berg’s lawsuit has been dismissed. The judge said Berg didn’t have standing to bring the law suit. This is ridiculous. World Net Daily is reporting that Berg told Michael Savage that he has a recording of Obama’s paternal grandmother in Kenya stating she was there in the maternity ward in Kenya when Barack Obama was born. He is waiting for an affidavit and said he will then release the tape. Berg believes the reason Obama won’t release his college records is due to the fact that he received foreign student aid, and that not only is Obama not a natural born citizen, that he is an illegal alien.
There are one or more details on his birth certificate – or on other documents – that don’t match one or several stories of his. This is normally the reason why a person does not want to give you access to this kind of document. It’s fairly difficult to plead privacy on this one.
There is also the problem that Obama is linked to, and responsible for, what is probably a forged document, and this might have some serious legal consequences.

The original suit included the FEC. None of the latest reports on the Berg case mention the FEC.
Can you imagine the MSM if this were McCain?
It’s simple, really. The Constitution says the President must be a natural born citizen. I’m sure we’ve never had a candidate before unwilling to provide proof. Wouldn’t we know it would be the mysterious Obama.
It’s a gigantic thumb of the nose to the American people.

There was a petition to the FEC that I wrote about over the summer, I’ll have to look into the status of that.
What would happen is Obama’s elected and then we find out he’s not a natural born citizen? Would the whole ticket be deemed a fraud?

To try to answer your question:
If Obama does not meet the eligibility criteria, and he knew about it, this might constitute fraud.
The political answer is probably that the Republicans know the answer. If it goes for Obama, they will do nothing obviously. If it goes against Obama, McCain will warn Obama, give him a chance to save face, and raise it, if he feels that the election is getting lost. That’s the way McCain works. Don’t forget that McCain did raise his eligibility problem and got it sorted politically, if not legally.
Legal experts – from this country, UK, Kenya and Indonesia – and some expensive legwork are required. Republicans don’t leak information on important matters.
Lonely conservative: the technical answer to your question is: it might constitute fraud, if the intent to mislead is proven. If it’s the case, which somehow I doubt it is, Obama could try the insanity defense. It might work.

I know I’m stating the obvious here but legally or not this should be a basic game over for Obama. On moral grounds alone. NO clean birth certificate, your out.

Endy – check the constitution; you do not need to be born in the USA to be able to run for President, you just have to be a citizen by right of birth. This is often confused simply because, unlike many countries, the US recognizes you as a citizen simply if you’re born in the USA (regardless of your parent’s nation origins & citizenship).
McCain was born in Panama to US parents and is therefore perfectly eligible.
Obama’s problem is that *if* he was born in Kenya, his father’s Kenyan citizenship trumps his mother’s US citizenship, since Kenya would regard him as a Kenyan citizen. US law doesn’t recognize dual citizenship*, and as he’d have Kenyan citizenship, he would have had to renounce his Kenyan citizenship once he turned 18. Of course that would mean he wouldn’t be eligible for nomination.
* This doesn’t mean you can’t have dual citizenship, if the other country does recognize dual citizenship. But as far as the USA is concerned, you’re either an American, or you aren’t. No middle ground.
It would seem to me that this is easily cleared up simply by producing the COLB. (Incidentally, you’d have thought this step was required by the political parties, but it appears not. Maybe it should become a required step?)

Even if O’s birth certificate is found to be genuine, the real issue is whether O gave up his citizenship when his mother moved to Indonesia, married an Indonesian citizen and had that Indonesian step-father ADOPT Obama. According to Indonesian law at the time, O would not have been able to maintain dual citizenship with the U.S. There is no evidence that he took action to regain his U.S. citizenship upon returning to Hawaii. Therefore, the additional 2 documents being requested in the lawsuit are, I think, what O is really hiding from and desperately trying to suppress.

Why haven’t the Hawaii newspapers confirmed the alleged Obama birth announcements?
MSM stars claim the birth announcements in two papers prove Obama was born in Hawaii. If the Hawaii papers don’t confirm them they are forged meaning ABSOLUTELY no proof that Obama is a US citizen.
