The American Constitution grants it's citizens the right to a fair trial. Al Qaeda combatants are not US citizens and even if they were they are engaged in a war against the United States. The Constitution does not give them the right to a United States trial as it would to American Citizens. President Bush declared war on Al Qaeda and therefore if they are allowed to a trial in the United States public court system it is the same as giving aid and comfort to the enemy. Their trial belongs in a military court since we are at war with them. Anyone who would give them aid and comfort is as guilty of treason as they are guilty of crimes against America. Article 3, Section 2, of the United States Constitution requires that all criminal trials be heard by a jury. It also specifies that the trial will be heard in the state the crime was committed. Yes, I realize what Khalid Sheikh Mohammed has done, and yes I believe that he deserves to be punished, but it is not my, Cheney's, your, or anyone's decision to ignore the United States Constitution. If you ignore even one portion of the constitution then you demean the entire document. If you can ignore one basic right, then you can ignore them all.
