President Obama has declared the Defense of Marriage Act is unconstitutional. This is not about the merits of the Defense of Marriage Act, this is about an complete abuse of power. Neither the President nor the Attorney General has any right to decide which federal laws they will uphold.
President Obama believes that the Defense of Marriage Act is unconstitutional and will no longer defend the 15-year-old law in federal court, the Justice Department announced today.
This is unbelievable.
You can read the letter from the DOJ to Speaker Boehner at National Review.
Addendum: Since when does he care about the Constitution? His administration has been in contempt of court, for crying out loud. He’s in contempt of the people.
Update: Memeorandum now has a thread.
Update 2: The Volokh Conspiracy has more on this executive power grab.

Big Ears is NOT the Supreme Court.
At this point I think it was a good choice picking Joey the Clown for VP.

Add that to the Bill of Particulars when he is impeached.

With “no controlling legal authority”, Dear Leader has obviously chosen “selective” assent to laws. Absent of all shame, he gloats.

First, Lonely conservative, I love your blog. It is simple, but direct and easy to share with others.
Now to the article above. Where does the current president and DOJ determind they have to right to declare any policy unconstitutional and/or within the constitution. First and foremost, they do not govern by our constitution so why are they now trying to decide what is or is not within those laws. Many of us are appalled at the brashness of this administration and feel we are on the verge of dictatorship if americans do not step up to the plate and defend our country from those who seek to destroy it from within.

Thanks, cyn. I don’t know where they think they find that right. Follow the link to the Volokh Conspiracy. They’re more well versed on the law than I am, and they, too, believe this is a terrible power grab.
